EXECUTIVE ORDER NO. 63 s. 2024

REVOKING THE POLICY OF GRANTING CAREER EXECUTIVE SERVICE RANK TO GRADUATES OF THE NATIONAL DEFENSE COLLEGE OF THE PHEIPPINES

WHEREAS, Section 2, Article IX-B of the Constitution provides that appointments in the civil service shall be made only according to merit and fitness to be determined, as far as practicable, and except to positions which are policy-determining, primarily confidential, or highly technical, by competitive examination;

WHEREAS, Presidential Decree No. 1 (s. 1972) mandated the Career Executive Service Board to promulgate rules, standards and procedures on the selection, classification, compensation and career development of members of the Career Executive Service;

WHEREAS, Section 8, Chapter II, Book V of Executive Order (EO) No. 292 or the "Administrative Code of 1987" states that the entrance to the third level (Career Executive Service [CES]) positions shall be prescribed by the Career to Executive Service Board (CESB);

WHEREAS, EO No. 696 (s. 1981), as amended by EO Nos. 771 (s. 1982) and 145 (s. 2021), provides that graduates of the Master in National Security Administration (MNSA) program of the National Defense College of the Philippines (NDCP) who are appointed to CES positions shall be granted CES rank that is commensurate to their respective CES positions, subject to the requirements to be prescribed and mandated by the CESB;

WHEREAS, pursuant to Memorandum Circular (MC) No. 35 (s. 2023), on 22 February 2024, the CESB recommended to revoke the policy of granting CES rank to the graduates of MNSA Program of the NDCP to synchronize the standards and procedures for the conferment of CES rank; and

WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the mandate to ensure the faithful execution of laws;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Revocation. The policy granting CES eligibility and rank to graduates of the MNSA program of the NDCP under EO No. 145, is hereby revoked. As may be necessary, the CESB, in coordination with concerned government agencies, shall formulate and issue guidelines for the effective implementation of this Order.

Section 2. Repeal. Sections 1 and 2 of EO No.145 are hereby repealed. All other orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

Section 3. Effectivity. This Order shall take effect immediately upon its publication in the Official Gazette or a newspaper of general circulation.
